has power to grant licences on these terms (Article 6th of the
same Agreement). The Agreement does not say that such certi-
cates must be presented in India but it clearly says that they
are to be produced before the Governor of Macau. Therefore
under these circumstances the Condition 3rd as proposed by Your
Excellency (though in no way prejudicial to the opium trade in
Macau, as the Governor of Macau never grants any licence which
would in any way contravene any articles of the said agreement)
would seem to appear in a way to be a sort of fiscalization
upon the acts of the said Governor which foreign to the
prescribed convention made between the two countries.
Conditions 4th and 5th. Article 7 of the Agreement
made between Great Britain and Portugal provides that the
Government of India will permit of the purchases of opium in
Calcutta, in Bombay and for in other parts of India, intended
for Macau therefore without modification of the Agreement the
restriction which Your Excellency proposes to make does not
-
appear possible.
Condition 6th. I am in perfect accord with Your
Excellency's suggestion that the date mentioned under this Con-
dition be altered to 16th and 15th June.
It appears to me better so as to allow the Concession-
ary to dispose of the boiled opium required for sale from the
1st day of the contracted year.
4. I have further to add for Your Excellency's informat- ion that whatever modifications or interpretations that lie within the said Agreement which are beyond my power to decide, shall be transmitted to the Home Authorities and to them also
